Terms of use
In short. Bortio is a record-keeping tool for your vehicle. It shows what you recorded and reminds you about dates you entered. It does not take over your legal duties as a vehicle owner, and it is provided as is, without warranties. If you do not agree with these terms, do not use the app or this website.
1. Who provides Bortio
The Bortio mobile application and bortio.com (together, "Bortio") are operated by Nikita Afanasiev, an individual software developer ("I", "me"). Contact: hello@bortio.com. How your data is handled is described separately in the privacy policy.
2. What Bortio is, and what it is not
Bortio is a private log of your vehicle's maintenance, expenses, mileage and documents. Its records are what you entered or attached: Bortio does not verify them against any external source, and a history kept in Bortio is your own record, not an independently certified vehicle history. Values the app computes, such as consumption or cost per kilometre, are derived from your records and marked as such; where the data is too thin, the app shows nothing rather than a guess.
3. Reminders are an aid, not a guarantee
Reminders and notifications exist to help you, and they can fail: a phone can be off, an operating system can delay or drop notifications, a battery-saving mode can silence them, a date can be entered incorrectly. You remain fully responsible for every legal deadline connected to your vehicle, including inspection, insurance, tax and licensing, regardless of whether Bortio reminded you. For statutory deadlines, the authoritative source is always your documents and the relevant authority, never an app.
4. Your data and your backups
Bortio is local-first: your records live on your device, and I hold no copy. That is a privacy feature with a consequence you accept by using the app: if the device or the app's data is lost and you kept no export or transfer file, the records cannot be recovered by anyone. The app provides export and transfer tools; keeping backups of anything you would not want to lose is your responsibility.
5. Early access
Bortio is in development. Anything said on this website about upcoming platforms, features or timing is a statement of intent, not a promise. Joining the early access list creates no obligation on either side.
6. Purchases
Optional paid upgrades are sold through the application store (currently Google Play), under that store's own terms of service and refund policy. Prices are shown by the store in your currency. What a purchase unlocks is described in the app at the moment of purchase; features that are marked as in development are not part of what you buy. Nothing in these terms limits the statutory rights you have as a consumer in your country.
7. Acceptable use
Use Bortio only for its purpose and in accordance with the law. Do not attempt to disrupt the service, probe or overload its infrastructure, abuse the forms on this website, or misrepresent a Bortio export as an independently verified vehicle history when selling a vehicle.
8. Intellectual property
The app, this website, and the Bortio name and logo belong to the operator. Your records, photographs and documents remain yours; Bortio claims no rights over them beyond what is technically needed to store and display them for you.
9. No warranty
To the maximum extent permitted by applicable law, Bortio is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy of computed values, and uninterrupted or error-free operation. No advice or information obtained from Bortio creates a warranty.
10. Limitation of liability
To the maximum extent permitted by applicable law, I am not liable for indirect or consequential losses arising from the use of, or inability to use, Bortio. This includes, without limitation: fines or penalties for missed inspections, insurance lapses or other statutory deadlines; damage to a vehicle; losses connected to the sale of a vehicle; lost profits; and loss of data for which an export or backup tool was available and not used.
To the extent liability cannot be excluded, my total aggregate liability for all claims connected to Bortio is limited to the greater of the amount you paid for Bortio in the twelve months before the claim arose, or 10 €.
Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for intent or gross negligence, and nothing here affects mandatory consumer protections of the country where you live.
11. Changes and severability
If these terms change, the date at the top changes with it, and material changes will be announced in the app before they take effect. If any provision of these terms proves unenforceable, the remaining provisions stay in force.
